摘要: 碳捕集、利用与封存(CCUS)是实现深度脱碳和碳中和目标的重要技术路径,其规模化发展与风险控制依赖稳定、可预期的监管法律体系。CCUS全链条、长周期与跨区域的特征对CO2法律属性界定、封存孔隙空间权属、长期责任分配及跨部门审批等提出了独特的监管挑战。中国CCUS监管法律体系已在政策支持、标准建设、环境管理和示范实践等方面取得积极进展,但在专门立法、关键权属界定、长期责任安排和全周期监管等方面仍有待完善。国际经验表明,CCUS监管制度正逐步形成覆盖项目准入、运行监管、关闭后管理和跨区域协调的全周期制度框架。基于此,本文围绕制度建设、标准核算、项目管理和跨区域治理提出政策建议,以期为完善中国CCUS监管法律体系提供参考。

Abstract: Carbon capture, utilization and storage (CCUS) is an important technological pathway for achieving deep decarbonization and carbon neutrality. Its large-scale development and risk control depend on a stable and predictable regulatory legal framework. The full-chain, long-cycle and cross-regional characteristics of CCUS pose distinctive regulatory challenges for defining the legal status of CO2, determining ownership of pore space for storage, allocating long-term liability and coordinating cross-departmental approval procedures. China’s CCUS regulatory legal framework has made positive progress in policy support, standard development, environmental management and demonstration practices. However, further improvement is still needed in dedicated legislation, definition of key property rights, long-term liability arrangements and full-cycle regulation. International experience shows that CCUS regulatory systems are gradually forming full-cycle institutional frameworks covering project access, operational regulation, post-closure management and cross-regional coordination. Based on this, this paper proposes policy implications regarding institutional development, standards and accounting, project management and cross-regional governance, so as to provide reference for improving China’s CCUS regulatory legal framework.
