欧盟航空碳关税的进展、影响及应对

摘要: 碳市场中的排放配额属于广义上的碳关税。欧盟2023/958号法案提出,将欧盟离境航班的全程碳排放有条件纳入欧盟排放交易体系(EU ETS)的配额管理,并将单边扩张条件与国际航空碳抵消和减排机制(CORSIA)的实施效果和范围挂钩。同时,加速实施100%的航空碳排放配额拍卖,以及符合欧盟标准的可持续航空燃料(SAF)强制加注。欧盟的航空碳关税单边行动,违背了联合国气候变化框架公约(UNFCCC)基本原则以及《国际民用航空公约》和“双边航空运输协定”,会导致国际航空市场的扭曲、发达国家转嫁国际航空减排责任以及对新型能源市场的垄断和再次从发展中国家攫取巨大经济利益。2026年7月17日,欧委会公布COM(2026)616号提案,拟将航空碳交易扩围安排调整为“5000公里圈+推迟2年+2032年审查”,新增“ETS服务条款”、大幅加码SAF配额补贴,再一次引发全球航空运输业对欧盟航空碳关税的关注。为维护全球航空运输业发展权益、推动全球航空运输业的可持续发展,文中建议遵循共同但有区别责任原则(CBDR),坚持多边治理与协商,运用国际规则与法律工具做好对等反制预案,加快推进航空飞行活动纳入全国碳市场进程,并加强SAF产业与标准体系建设,提升行业企业应对能力。

Abstract: Carbon allowances in Emissions Trading Systems are broadly categorized as carbon tariffs. Directive (EU) 2023/958 proposes the conditional inclusion of the entire-route carbon emissions from flights departing the European Union (EU) into the allowance management of the EU ETS, with unilateral expansion linked to the implementation scope and effectiveness of the International Civil Aviation Organization (ICAO)’s Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA). It also accelerates the full auction of aviation carbon allowances and mandates the use of EU-compliant sustainable aviation fuels (SAF). On 17 July 2026, the European commission published the proposal COM (2026) 616, which would replace the full-scope extension of the EU ETS under Directive (EU) 2023/958 with a “5000 km circle plus two-year deferral plus 2032 review” arrangement, introduce an “ETS as a service” clause, and significantly scale up allowance support for SAF, triggering renewed global attention to the EU’s aviation carbon tariff. The EU’s unilateral aviation carbon tariff runs counter to the fundamental principles of the UN Framework Convention on Climate Change (UNFCCC), the convention on international civil aviation, and bilateral air transport agreements. It will substantially escalate airlines’ financial burdens and erect carbon barriers hindering the growth of aviation transport and relevant industries in developing countries. Furthermore, the relevant policy will distort the international aviation market, enable developed countries to shift their international aviation emission reduction obligations, facilitate their monopoly over aviation cleaner energies markets, and allow them to extract enormous economic gains from developing countries once again, while boosting the EU’s negotiating leverage in global aviation decarbonization. To safeguard the rights and interests of the global aviation industry and promote its sustainable development, this paper advocates adherence to the principle of common but differentiated responsibilities (CBDR), upholding multilateral governance and consultation, making full use of international rules and legal instruments to prepare reciprocal countermeasures, accelerating the integration of aviation emissions in China’s national carbon market, and strengthening the SAF industry and its standards system to enhance the response capacity of the industry and enterprises.
